| Stranded Jetsgo passengers in Ontario can apply
for compensation through an industry compensation fund, but only
if they booked their travel with a registered Ontario travel agent. Those who bought tickets directly from the airline
over the internet are not covered and should seek contact their
credit card company to request a charge back.
Ontario Regulation 806/93 made under the Travel Industry Act requires
travel agents to contribute into a Compensation Fund that protects
consumers from the bankruptcy of end-suppliers, including airlines
and cruise companies. The Fund is entirely financed by registered
travel agents and travel wholesalers in Ontario and is administered
by the Travel Industry Council of Ontario (TICO).
Items not eligible for compensation from the Fund include: taxes,
insurance, the cost of alternate (replacement) travel, discount
certificates, vouchers, prizes or any goodwill gestures used in
lieu of a payment by cash, cheque or credit card.
The TICO Board of Directors determines whether a claim meets the
requirements of the regulation. The Board is comprised of individuals
appointed by the Association of Canadian Travel Agents - Ontario,
the Canadian Association of Tour Operators, the Canadian Institute
of Travel Counsellors, the Ontario Motor Coach Association, the
Ministry of Consumer and Business Services and individuals elected
by registered travel agents and wholesalers. Payments out of the
Fund are limited to a maximum of $5,000 per passenger and to a total
of $5 million per event.
Affected consumers should be certain to retain all original documents
including receipts, invoices, returned cheques, credit card slips,
credit card statements. To apply for compensation, clients should
